I possesses broad legal experience in the healthcare industry in various roles as a plaintiff, defendant, and neutral. I have acted as a solo and panel arbitrator in commercial arbitrations, including healthcare payor/provider and medical necessity disputes, and consumer arbitrations. My healthcare arbitration experience includes disputes ranging from $75,000 into the millions in alleged damages. I have been a Tennessee Supreme Court-appointed panel arbitrator and solo hearing examiner in numerous professional responsibility and disciplinary matters involving issues of legal ethics and malpractice. I also have served as a federal court-appointed Rule 53 Special Master addressing discovery and eDiscovery issues in healthcare business litigation involving contract, tort, and statutory claims with amounts in dispute exceeding $30 million. In addition to my current roles as an arbitrator, I served in a quasi-neutral role in several mediations as an AUSA. At the invitation of the parties, and with the permission of the Department of Justice, I attended mediations in healthcare and procurement fraud qui tam cases in which the United States had declined to intervene and helped facilitate negotiations and resolutions between the parties. I also have experience as an advocate both healthcare arbitrations and mediation. For example, I acted as co-counsel for the United States in the mediation of FCA litigation involving allegations of upcoding and miscoding of healthcare services with disputed claims of over $90 million. Beyond my roles as a neutral, I am the head of Sherrard Roe Voigt & Harbison’s Government Compliance & Investigations group concentrating my practice in Commercial Litigation, Government Investigations, White Collar Litigation, and Alternative Dispute Resolution. I represent healthcare clients in False Claims Act (FCA) and other government investigations, privileging and licensure issues before federal and state agencies, and general business disputes. I evaluate and argue issues of medical necessity, upcoding, and other payor/provider issues as a plaintiff, defendant, and neutral through the various components of my practice. I have also represented clients in negotiations of administrative actions related to government investigations, including suspension, debarment, and corporate integrity agreements. I have written and presented extensively on healthcare law matters, including billing and fraud matters and the intersection of FCA enforcement and Health IT, particularly on compliance issues relating to EHR systems. In transactional matters, I advise clients on healthcare compliance and regulatory matters, service subcontracting agreements, and non-compete clauses. I represent clients in negotiations of administrative actions related to government investigations including suspension, debarment, and corporate integrity agreements. As an AUSA, I contributed to the return of over $100 million to the public fisc. Core case issues included medical necessity, upcoding and miscoding of claims, physician compensation and supervision, durable medical equipment, EHR systems, kickbacks, and the Stark Law. I also employed my healthcare experience in the defense of medical malpractice claims brought against federal agencies through the Federal Tort Claims Act. The breadth of this healthcare, litigation, and ADR experience, and the different roles I have played in healthcare disputes, give me a valuable perspective as a solo or panel arbitrator.
