If the cancellation is for an unforeseen emergency there is no charge. If the cancellation is for other reasons and is at least two weeks prior to the scheduled mediation or is rescheduled, I will not charge a cancellation fee. Generally, if the cancellation is less than two weeks out and not rescheduled, I would expect the parties to pay 1/2 of the anticipated fee. For example if the mediation was scheduled for two days at a rate of $2,800 a day, the cancellation fee would be $2,800. In the event that I was able to reschedule another mediation or fill that time with billable work for clients, I would waive the cancellation fee. With respect to any cancellation, I would expect to be reimbursed for expenses I have incurred, such as for air travel, that cannot be refunded. I am willing to negotiate cancellation fees and will give reasonable consideration to the circumstances surrounding the cancellation.
