Jeanne Franklin
Lawyers making neutral selection have specific needs in mind. I recommend selecting me for disputes and cases that involve or flow from provider-provider and provider-hospital disputes that are not just about money. Employment issues, contract interpretation and perceptions of quality practice or ability to work effectively with others generally involve personal issues - no matter how rational, intelligent and well-intentioned the players in the dispute are. I have honed skills in calming, managing and inspiring parties seemingly stuck in bad situations to want to try to compromise and find solutions both can live with, modeling patience, respect for the parties and building their trust so they will begin to want to follow gentle lead from me although I do not directly evaluate their case. Once trust is developed, the ethics of a mediator become even more important; I must do what I say I will do - which is help them think of ways to reach a resolution in which both will gain something even though both likely have to yield something. That is my strength and where I am very comfortable. In my experience these situations flow from power issues, perceptions of fairness/unfairness, fear and ego. Most of the disputes I have handled are rooted in miscommunication that was not flagged and handled early on and the miscommunications become layered. Some disputes are not tractable and need to go to a decision-making process. I enjoy speaking with lawyers in advance to help the lawyers assess what to do with their cases in terms of dispute resolution options. Out of 161 mediations, I have achieved over an 80% actual settlement agreement rate and a higher "success rate" (well over 90%) by which I mean the parties did not enter into a written agreement at the time but feel the situation is improved, report that they gained value from the process and/or that they learned something valuable that will help them move forward. I take my ethical duties to all concerned very seriously. Please see my website that shows 2 videos in which I explain the process and how I approach it. www.franklinsolutions.net
