I have served as in house and outside counsel, as defense attorney and plaintiff's counsel, on all sides of the fence. My current practice focuses on dispute resolution and representing clients in the healthcare, life sciences and biotechnology industries, including regulatory, administrative appeals, corporate and transactional law, and litigation. My career began as a litigator, primarily pharmaceutical and medical device products liability lawsuits, toxic torts and environmental litigation, class actions, insurance coverage disputes, and shareholder suits. I served as chief counsel for the US manufacturing division of an international medical device company, in-house corporate counsel for a regional academic medical center, and chief counsel for a national pharmacy benefit management corporation (PBM). I have represented clients in appeals, litigation and dispute resolution, and served as a neutral, on a broad range of matters, including commercial and transactional contracting (e.g., manufacturing, sales, research agreements, licensing, acquisitions, physician contracting); FDA and federal health care program compliance and investigations; critical access/rural health; government subpoenas, civil investigative demands, self disclosures and corporate integrity agreements; negotiations and disputes with state and Federal regulatory authorities (OIG, CMS, FDA, EPA, OSHA, DEA, DOT); Stark law, anti-kickback, and fraud and abuse; HIPAA/HITECH; clinical research law, human subjects protection, and institutional review boards (IRB); Medicare and Medicaid, including termination actions; government and third party payor reimbursement and coverage; managed care contracting and disputes; overpayment audits, Recovery Audit Contractor (RAC), program integrity contractors, and Medicaid integrity contractors; CLIA and other state and Federal laboratory laws; and pharmacy law.
