Scotty Shively

Attorney Arbitrator/Mediator

The combination of my past legal and neutral training and experience uniquely qualify me to arbitrate healthcare cases. I bring not only the practical side from actually litigating issues, but also the academic training and experience of a neutral. I have practiced law for over thirty-five years. The early part of my practice was almost exclusively in the litigation of, and advising on, employment and labor law matters. A number of these clients were in healthcare, and within five years I began representing healthcare clients in other areas as well. Because Arkansas is a small state, I had the opportunity to practice as a health law generalist. I represented a wide variety of providers, and other stakeholders in the healthcare industry, including hospitals, nursing homes, home health and hospice agencies, clinics, individual practitioners, managed care organizations and a QIO. I represented clients on a wide variety of healthcare issues, including fraud and abuse, anti-kickback, false claims, medical staff issues, licensure and certification, certificate of need, reimbursement, medical malpractice and nursing home liability, HIPAA and privacy issues, and other issues that arise in provider practices. I appeared before federal and state courts and agencies and commissions that regulate healthcare providers and employers. For the past twenty years, my practice has also included arbitration and mediation as a neutral. In 2004, I completed a 200 hour Graduate Certificate in Conflict Resolution.
