Dispute resolution is not a side project for me. It is my full-time profession. I have dedicated more than thirteen years exclusively to mediation and arbitration, with over 2,000 completed matters. I serve as a FINRA Public Arbitrator, a Florida Supreme Court Qualified Arbitrator on the Florida 12th and 17th Judicial Circuit rosters, and a certified or qualified mediator in six states: Florida, Texas, Georgia, Nevada, Louisiana, and California. I bring the same energy and preparation to every matter, regardless of size or complexity.
My background in healthcare is real and operational. Earlier in my career, as Executive Director of an organization of more than 200 employees, I led operations and negotiated managed care contracts. I understand how such institutions function from the inside: the business pressures, the regulatory environment, the operational priorities, and the competing interests at stake. I see all sides.
I completed AHLA's Health Care Arbitration Training and am pursuing inclusion on AHLA's Dispute Resolution Service arbitration roster. That training, combined with my extensive neutral experience, gives me a working command of the procedural and substantive issues that arise in healthcare ADR.
I am accessible, responsive, and prepared. I read every document submitted. I tailor discovery and proceedings to what is actually needed. Virtual hearings through AHLA are arranged on AHLA's designated platform, and I am available on short notice when needed.
I am a Director at the Association for Conflict Resolution (Chair, Governance Committee) and a Director at the Florida Academy of Professional Mediators. I am bilingual in English and Spanish, and I have presented cultural competency programs to ADR professionals across multiple organizations.
If there is common ground to be found, I will help you find it.
All travel by private auto is reimbursed at the IRS mileage rate in effect on the date of travel, or the most recently published rate if no current rate is available, plus parking and tolls.
For travel by private auto to destinations within 40 miles of my office, no travel time is charged. For travel by private auto to destinations beyond 40 miles, or for any commercial transportation, total door-to-door travel time is charged at $100 per hour, up to a maximum of four (4) hours per day, inclusive of all modes of transport, waiting time, and ground transportation to and from the departure and arrival points. Travel time is charged separately from and in addition to the neutral's standard hourly rate.
For domestic travel by commercial transportation, airfare is booked at the Business Class rate and reimbursed at 100% of actual costs incurred. The neutral will make reasonable efforts to book refundable airfare. Where refundable airfare is unavailable or cost-prohibitive, non-refundable airfare may be booked, and the cancellation provisions herein shall apply. All additional travel expenses, including hotel, transfers, ground transportation (rental cars, rideshare, and taxis), and meals at the applicable GSA per diem rate for the destination (the federal government's standard daily meal reimbursement rate for the applicable destination, published annually by the U.S.
General Services Administration and available at gsa.gov), are invoiced at 100% of actual costs incurred.
Travel expenses are divided equally among the parties unless otherwise agreed in writing by the parties or ordered by the court. Where there are more than two parties, travel expenses are divided equally among all parties unless otherwise agreed in writing or ordered by the court. International travel is by separate written agreement.
For all cancellation terms, including travel-related costs, see Cancellation and Postponement section below.
I offer virtual/video conference hearings and am available to serve as neutral on a nationwide basis, whether in person or virtually.
"Time booked" means the number of hours confirmed in writing in the engagement agreement or scheduling confirmation. If no specific hours are confirmed, a four (4) hour minimum per day applies. A full hearing day is eight (8) hours, inclusive of all breaks. The neutral's standard hourly rate is $300 per hour, with a four (4) hour minimum per day. For purposes of this policy, appointment occurs upon formal written confirmation of the engagement, whether by AHLA assignment or direct agreement of the parties.
All cancellations and postponements are subject to the following schedule, based on the number of calendar days notice provided prior to the scheduled hearing or session date. Notice of cancellation or postponement must be provided in writing and is effective upon confirmed receipt by the neutral. Postponement of a scheduled hearing or session by either party, regardless of reason, is treated as a cancellation for purposes of this policy. The applicable fee is determined by the number of calendar days notice provided.
Cancellation Fee Schedule:
* 21 calendar days or more: No cancellation fee.
* 6 to 20 calendar days: $600 per day booked ($300/hour x two hours per day).
* 5 calendar days or fewer: 50% of total time booked at $300/hour, calculated as 50% of confirmed hours at $300/hour, but never less than $600 per day (50% of the four hour minimum per day).
Study, file review, and pre-hearing preparation time completed prior to cancellation is billed at $200 per hour and is due in full regardless of when cancellation occurs. Cancellation fees under this schedule apply exclusively to scheduled hearing days and are calculated at the hearing rate of $300 per hour.
If the cancelling or postponing party wishes to reschedule, 50% of the cancellation fee will be credited toward the new booking, provided both parties bilaterally confirm a new date and time within three (3) business days of the cancellation or postponement. If both parties do not bilaterally confirm a new date and time within three (3) business days, no credit is given. An agreement to reschedule without a confirmed date and time does not qualify for the credit.
If a hearing or session is terminated after commencement, the full reserved time for the day of termination is billed at the standard hourly rate. All remaining reserved days are treated as a cancellation with five calendar days or fewer notice, and the applicable cancellation fee applies.
A matter that resolves after formal written confirmation of the engagement is treated identically to a cancellation under this schedule, based on the number of calendar days between notice of resolution and the scheduled hearing or session date.
This policy is consistent with industry standard practice for professional neutrals. All cancellation fees and reimbursement of actual expenses incurred, documented by supporting records, are invoiced through AHLA in accordance with AHLA billing procedures.
Travel-Related Cancellations:
In the event of cancellation after travel has been booked, the cancelling party is responsible for 100% of all costs, including any airfare that is non-refundable or reimbursed only as an airline credit or voucher. Airline credits or vouchers issued as a result of a party's cancellation are not considered reimbursement to the neutral. If both parties cancel, non-refundable travel costs are divided equally among the parties, or as otherwise agreed in writing or ordered by the court. Where one party has agreed in writing to bear all travel costs, that party remains responsible for 100% of all costs in the event of cancellation by either party. The paying party's recourse for any cancellation-related costs is solely against the cancelling party and does not affect the neutral's right to payment.
Virtual hearings through AHLA are arranged and managed by AHLA on its designated platform.
There is no charge for opening a file. If a matter resolves after appointment and the neutral's completion of AHLA intake requirements, a minimum administrative fee of one (1) hour at the standard hourly rate of $300 is charged.
Hourly Rates:
* Hearings: $300 per hour, with a four (4) hour minimum per day.
* Study, file review, and pre-hearing preparation: $200 per hour.
* Decision drafting and post-hearing work: $300 per hour.
* Half-day hearings: $1,200 (four hours).
* Full-day hearings: $2,400 (eight hours, inclusive of all breaks).
All fees and costs are divided equally among the parties unless otherwise agreed in writing by the parties or ordered by the court. All invoicing is processed through AHLA in accordance with AHLA billing procedures.
